नई दिल्लीः सीनियर एडवोकेट आर. के. आनंद और आई. यू. खान को अदालत की अवमानना का दोषी करार देते हुए दिल्ली हाई कोर्ट ने सरकारी वकील के रूप में खान की भूमिका पर सख्त टिप्पणी की।
हाई कोर्ट ने कहा कि खान के लंबे अनुभव और उनकी कानूनी दक्षता के मद्देनजर ही दिल्ली सरकार ने उन्हें बीएमडब्ल्यू जैसे महत्वपूर्ण मुकदमे में विशेष सरकारी वकील नियुक्त किया था। लेकिन अभियोजन ने सपने में भी नहीं सोचा होगा कि उसके भरोसे को इस तरह तार-तार किया जाएगा।
आनंद और खान दोनों ही समाज में रसूख रखते हैं। रसूख वाले लोगों से समाज जिम्मेदारी के व्यवहार की अपेक्षा रखता है। करियर बनाने की चाहत और अति उत्साहित नौजवान वकील से अनजाने में 'लक्ष्मण रेखा' पार हो सकती है और वह अदालत की अवमानना कर सकता है। लेकिन दो सीनियर वकीलों से बेहतर कंडक्ट की अपेक्षा की जाती है।
दोनों ही कानून की बारीकियों को भली-भांति जानते हैं। लेकिन उन्हें अपने किए पर पछतावा भी नहीं है। सुनवाई के दौरान उन्होंने किसी भी तरह की माफी नहीं मांगी।
गौरतलब है कि एक प्राइवेट टीवी चैनल ने 30 मई 2007 को स्टिंग ऑपरेशन टेलिकॉस्ट किया था। उसमें बीएमडब्ल्यू कांड के गवाह सुनील कुलकर्णी से खान और आनंद की बातचीत के अंश दिखाए गए। स्टिंग में रुपयों के लेनदेन की बात भी आई थी। स्टिंग पर दिल्ली हाई कोर्ट ने खुद पहले करते हुए दोनों वकीलों के खिलाफ कार्रवाई शुरू की थी। लंबी सुनवाई के बाद हाई कोर्ट ने इस साल दो मई को अपना फैसला सुरक्षित रख लिया था। लगभग साढ़े तीन महीने के बाद आए फैसले ने वकीलों के बीच हलचल मचा दी है।
याद हो कि बीएमडब्ल्यू कार ने 10 जनवरी 1999 की रात सात लोगों को कुचल दिया था। सुनील कुलकर्णी इस कांड का गवाह बनकर उभरा था। हालांकि अभियोजन ने उसे बाद में गवाहों की सूची से हटा दिया था। इस कांड का मुख्य अभियुक्त संजीव नंदा है। संजीव नंदा नौसेना के रिटायर्ड प्रमुख एस. एम. नंदा का पोता है। संजीव के पिता सुरेश नंदा हथियारों के प्रमुख सौदागर हैं।
English Translation
On Thursday R K Anand and IU Khan have been found guilty of criminal contempt of court। It's the first time in India's history that a verdict of this kind has been delivered against such senior advocates.
Anand was not in court, the one time MP had all along accused NDTV of doctoring tapes. IU Khan, the public prosecutor, had been caught on camera sending his witness to meet R K Anand. Khan heard the judgement then left the court without speaking to the media.
After a year spent reviewing NDTV's unedited footage, the high court announced its judgement in the most severe terms. Both I U Khan and he have been found guilty of criminal contempt of court.
The two judges said:
"We are left without a shadow of doubt that Mr Anand who was a key player was interfering or at least tending to interfere in the due course of judicial proceedings. The unshakable truth is that Mr Anand is guilty of criminal contempt of court."
The penalty decided by the court: R K Anand and I U Khan cannot practice in the high court or any lower Delhi court for four months but the harshest indictment was that the judges recommended that both Anand and I U Khan be stripped off their designations as senior advocates.
The judges further said:
"We are dealing with senior advocates who are expected to conduct themselves as gentlemen and role models for younger members of the bar. Both Mr Anand and Mr Khan have not tendered any apology conditional or unconditional, expressed any contrition or repentance for their conduct."R K Anand was not in court for the verdict.
One year ago he watched the expose as it was broadcast on NDTV with his client Sanjeev Nanda and fought back with this defence.
For the lawyer and one time MP, the fall from grace is complete. This is the first time that such a senior lawyer has faced this sort of action.And while the verdict sets a huge new precedence, many lawyers argue the significance far outweighs the actual punishment.
"They should be sent to jail," said Prashant Bhushan, Lawyer.
Whether both Anand and Khan are forbidden from using the title of senior advocates, will now be decided by a full bench five judges of the high court.
However, the bar council is already offering its support, proving that experts are right when they say lawyers protect their own even when evidence proves they're guil the witness who both Khan and Anand were trying to influence and a man whose own reputation and actions proved that he was as guilty of trying to sabotage the case.
But the ultimate goal was to prove how often and how easily justice is subverted in India. The verdict will hopefully help fight what has been a part of our system for so long.
