रामालिंगा राजू के ख़िलाफ़ सी बी आई ने किया मामला दर्ज - फरवरी 21, 2009

The Central Bureau of Investigation today registered a case against disgraced Satyam founder B Ramalinga Raju and constituted a multi-disciplinary investigation team for its probe.The first information report has been lodged against Raju, former chairman of Satyam Computer Services Ltd, directors and the auditor of the firm, among others. The FIR has been filed under Section 120-B, readable with sections 409 (criminal breach of trust), 420 (cheating), 467 (forgery of valuable security), 468 (forgery for purpose of cheating), 471 (using as genuine a forged document) and 477 A(falsification of accounts) of the Indian Penal Code. The CBI has taken up investigation of the case from Andhra Pradesh CID crime branch.

To carry investigations further, a team of the Hyderabad CBI took possession of documents, statements and other evidence collected by the CID and a team of experts are studying them. The CBI will have to reportedly finish its investigation soon as the 90-day deadline for filing of a chargesheet in the case is approaching. CBI sources said that they would also soon apply for Raju’s custody to interrogate him.

सत्यम के प्रवर्तक बी रामलिंगा राजू के कंपनी के खातों में हेराफेरी और मुनाफ़े को बढ़ा-चढ़ाकर पेश करने की बात स्वीकार करने के क़रीब एक महीने बाद प्रदेश सरकार ने ये फ़ैसला किया। इसके पहले राज्य के मुख्यमंत्री राजशेखर रेड्डी ने प्रधानमंत्री को पत्र लिखकर इसकी सीबीआई जाँच की माँग की थी।इस पर कारपोरेट मामलों के मंत्री प्रेमचंद गुप्ता ने कहा था कि राज्य सरकार को इसके लिए औपचारिक सिफ़ारिश करनी चाहिए।

फिलहाल देश की इस चौथी बड़ी आईटी कंपनी में हुई हेराफेरी की जाँच गंभीर धोखाधड़ी जांच कार्यालय (एसएफआईओ) समेत कई अन्य एजेंसियों कर रही हैं।

इसमें सेबी, रजिस्ट्रार आफ कंपनीज, आंध्र प्रदेश सीआईडी, आयकर विभाग, प्रवर्तन निदेशालय भी शामिल हैं।

इस समय रामलिंगा राजू, उनके भाई रामा राजू और कंपनी के पूर्व मुख्य वित्त अधिकारी वी श्रीनिवास जेल में बंद हैं।

दूसरी ओर केंद्र सरकार ने सत्यम का बोर्ड भंग कर उसकी जगह नया निदेशक मंडल नियुक्त कर दिया था और मामले की जाँच के आदेश दे दिए थे।

The Andhra Pradesh Government has handed over the Rs 7,800 crore Satyam scam to the Central Bureau of Investigation (CBI).

Consequent upon these developments, the CID began work on the formalities for handing over the case to the CBI. It has collected nearly 200 trunk loads of documents, besides several computers during the search and seizure operations on the offices and residences of former Satyam chairman B. Ramalinga Raju and other top officials.

Also, Union Corporate Affairs Minister Prem Chand Gupta said that the case would be now jointly probed by the CBI, along with the Serious Fraud Investigation Office (SFIO) and other agencies.

In a new development, the government appointed board has asked US-based senior vice-president Anil Kumar to step down. Kumar was handling Satyam’s banking, finance and insurance vertical and was reporting to erstwhile interim chief executive Ram Mynampati.

Meanwhile, B. Ramalinga Raju, founder and former chairman of the software exporter, denied diverting funds from the firm using bogus companies. His lawyer S. Bharat Kumar issued a statement via email.

सरकार करेगी सत्यम के खरीदार की तलाश - फरवरी 13, 2009

सत्यम कम्प्यूटर्स का घोटाला अब देश की सबसे बड़ी पंचायत में पहुंच गया है। कल लोकसभा में कंपनी में हुए 7800 करोड़ रुपए के घोटाले और मामले में अब तक जो कुछ भी हुआ है उस सब पर चर्चा होगी।

ये फैसला सदन की व्यापार मामलों की कमेटी में लिया गया है जिसमें सभी पार्टी के सदस्य शामिल थे। सभी इस मासले पर चर्चा के लिए एक मत थे। UPA सरकार के आख़िरी संसद सत्र में कंपनी मामलों के मंत्री प्रेमचंद्र गुप्ता इस घोटाले पर सांसदों के सवालों का जवाब देंगे। इधर प्रेमचंद्र गुप्ता ने अपने सबसे ताजे बयान में कहा कि सत्यम संकट के दौर से बाहर आ गई हैं।

उन्होंने कहा कि सरकार सत्यम के लिए खरीदार की तलाश कर रही है और कंपनी का पूरा कामकाज संभालने को तैयार स्ट्रैटेजिक इंवेस्टर को भी कंपनी बेची जा सकते हैं।

ये मामला किस कदर राजनीतिक गलियारों की चर्चा में शामिल हो गया है इसका पता इसी बात से ही चल जाता है कि बीजेपी नेता लालकृष्ण आडवाणी ने भी आज इस पर प्रतिक्रिया दी। उन्होंने कहा, "ये अब महज़ धोखाधड़ी का मामला नहीं रह गया है इसकी बाकायदा न्यायिक जांच होनी चाहिए।"

उधर, सत्यम कम्प्यूटर्स में घोटाले के बाद बने नए बोर्ड के चेयरमैन किरण कार्णिक ने कहा है कि अब कंपनी की वित्तीय हालत सुधरी है। कार्णिक ने ये भी कहा है कि कंपनी की अच्छी लेनदारी से ग्राहकों का हमारे ऊपर भरोसा बढ़ा है।

गुरुवार को मुंबई में हुई बोर्ड की बैठक में कंपनी के आर्थिक हालात पर चर्चा की गई तब ये अनुमान लगाया गया। किरण कार्णिक ने ये भी कहा कि सत्यम के खातों की समीक्षा में अभी कुछ समय और लगेगा। लेकिन अगर खातों की समीक्षा में ज्यादा वक्त लगा तो कंपनी को बेचने पर जोर दिया जाएगा।

बैठक के बाद ये भी बताया गया है कि सत्यम में इनसाइडर ट्रेडिंग के मासले पर बोर्ड की SEBI से बातचीत हुई है और कंपनी को सत्यम को बेचने की प्रक्रिया पर अभी अंतिम फैसला नहीं नहीं लिया गया है।

The government today said it is looking at the possibility of finding a suitable strategic investor who can acquire the beleaguered Satyam Computer, while pointing out that the crisis at the company is over.

“The next step of the government is to find out some suitable strategic investor who can take care, takeover the company,” corporate affairs minister P C Gupta said at a PHDCCI function here.

He said all these possibilities are being worked out and the whole process would be carried out transparently. The crisis situation at the company is over, Gupta added. Satyam’s government-appointed board has said that it has received a number of offers for taking over the company, but has not decided on its sale. Satyam chairman Kiran Karnik had yesterday said the board would decide on the final road map for bringing the IT major back on rails in the next 10 days.
He, however, had refused to comment on the number of suitors for Satyam since “we have not yet formally invited any kind of applications. The roadmap will define what we tend to do.”

Many corporates like Mahindra &Mahindra, L&T and Spice are reported to be in the race for acquiring Satyam Computer.

रामालिंगा राजू की जमानत मंजूर नही हुई - जनवरी 29, 2009

एक स्थानीय अदालत ने सत्यम कम्प्यूटर्स सर्विसेज के संस्थापक और पूर्व चेयरमैन बी.रामलिंगा राजू, उनके भाई बी.रामा राजू और पूर्व वित्त अधिकारी वदलामणि श्रीनिवास की जमानत याचिका बुधवार को खारिज कर दी।

राजू के वकील एस.भरत कुमार ने कहा कि उनके मुवक्किल के पास अभी इसी न्यायालय में या फिर उच्च न्यायालय में अपील करने का विकल्प बाकी है। इस संबंध में दो दिनों में फैसला कर लिया जाएगा।

सत्यम कम्प्यूटर्स में करीब 70 अरब रुपए के घोटाले के बाद रामालिंगा राजू, रामा राजू और वदलामणि श्रीनिवास इन दिनों जेल में हैं। उल्लेखनीय है कि तीनों की न्यायिक हिरासत 31 जनवरी को समाप्त हो रही है।

मुख्य महानगर दंडाधिकारी डी.रामाकृष्णा ने राजू परिवार द्वारा संचालित एसआरएसआर एडवायजरी सर्विसेस के पूर्व महाप्रबंधक गोपालकृष्ण राजू की पुलिस हिरासत के लिए दायर पुलिस की याचिका पर गुरुवार तक के लिए अपना आदेश सुरक्षित रख लिया। न्यायाधीश रामाकृष्णा, गुरुवार को गोपालकृष्ण राजू की जमानत याचिका पर फैसला सुनाएंगे।

English Translation:

In a setback to Satyam founder B Ramalinga Raju, his brother and former MD Rama Raju and former chief financial officer of the IT major Vadlamani Srinivas, the sixth Additional Chief Metropolitan Magistrate dismissed their bail applications here on Wednesday.

Speaking to reporters, Ramalinga Raju’s counsel Bharat Kumar said his client would file either a review petition in the same court or go in for an appeal in a higher court. He said a decision in this regard would be taken in a couple of days.

Meanwhile in a related development, Chief Minister Y S Rajasekhara Reddy, who has come under fire from the Opposition for allegedly trying to shield Raju and his men, sent a letter to Prime Minister Manmohan Singh stating that he would welcome a CBI probe into the Satyam scam if the Centre deemed it fit.

In his two-page letter, Rajasekhara Reddy strongly denied reports that the State CID was not cooperating with Central agencies and took pains to explain how forthcoming the sleuths had been, in helping them probe the case.

The Chief Minister urged the Prime Minister to take steps to put in place a mechanism so that Central agencies like Securities and Exchange Board of India (Sebi) and Serious Fraud Investigation Office (SFIO) could be in touch with the State CID on a regular basis for sharing information and facilitating a thorough inquiry into the scam. “I want the guilty to be brought to book,” he asserted.

He dismissed allegations levelled by the Opposition parties that the State Government had been trying hard to dilute the case as “attempts to gain political mileage in an election year.” In the same breath, he sought to distance his government from the Maytas firms Maytas Infra and Maytas Properties both promoted by Ramalinga Raju’s family.

Maytas Infra had been awarded a number of prestigious projects, including the Metro Rail, prompting the Opposition to charge that the gover nment had favoured it. Rajasekhara Reddy explained, “Maytas Infra, as part of several consortia, had won the State projects but the process was through competitive bidding.” The Chief Minister went on to say that the CID had also been directed to probe possible links between Maytas firms and Satyam.

सी आई डी ने राजू पर कसा शिकंजा - जनवरी 20, 2009

विशेषज्ञों और सीआईडी के दल ने 120 प्रश्नों की सूची तैयार की है। सीआईडी इस बात की पुष्टि करने की कोशिश कर रही है कि क्या सत्यम के संस्थापक रामलिंगा राजू ने बेनामी लेन-देन के जरिये कंपनी का धन उड़ाया है।

सीआईडी के सूत्रों ने बताया ये प्रश्न राजू के घर और दफ्तर से 10 और 11 जनवरी को जब्त दस्तावेज पर आधारित हैं। सात जनवरी को राजू ने कहा था कि उन्होंने बरसों तक सत्यम के मुनाफे को बढ़ा-चढ़ाकर दिखाया और काल्पनिक परिसंपत्ति बनाई।

भाई रामा राजू के साथ उन्हें नौ जनवरी को गिरफ्तार किया गया और 10 जनवरी को श्रीनिवास को गिरफ्तार किया गया। तीनों को जेल भेज दिया गया। बाद में 7800 करोड़ रुपए के वित्तीय घोटाले के मामले में पूछताछ के लिए 18 जनवरी को पुलिस हिरासत में भेज दिया गया।

सूत्रों ने बताया सीआईडी का एक दल राजू से पूछताछ कर रहा है और उनके भाई एवं श्रीनिवास से भी अलग-अलग पूछताछ की जा रही है।

Though the interrogation is being directly handled by top cops of the state and the details of the quizzing are being closely guarded, sources said the questioning was mostly focused on the land dealings of the Raju brothers and the reason for fudging the
balance-sheet.

The interrogation is primarily aimed at reconstructing the confession statement made by Raju and check the veracity of the confession made by Vadlamani.

Though not on record yet, sources said the accused did tell the basic details about their land transactions and are yet to agree to the observations of the investigators on the siphoning off of Satyam funds into private accounts.

The first day of grilling on Sunday has not been of much use to the interrogators since they could do the questioning just for about one hour that too was used to seek basic information about the background of the accused and the genesis of the IT major Satyam. On Sunday, Ramalinga Raju was suffering from fever, which had to be handled by the investigators immediately by calling in doctors from a government hospital.

"All the three are fit now without any major health complication. Raju and other accused are not an exception to the stress any person would undergo during the interrogation," the source said. In fact, the interrogators too are taking every care to ensure that the accused are not put under any undue pressure and the interrogation too is being conducted in the presence of their counsel.

HDFC chairman and government-nominated director on Satyam board Deepak Parekh on Thursday announced that the crisis-ridden IT major could raise funds by mortgaging its assets instead of looking for a bailout package.

“Financial assistance can be generated by hypothecating some of the assets of the company,” Mr. Parekh said when asked if a rescue package was under preparation. The company, he said, had large receivables and assets could be hypothecated. This could be done after obtaining the audit report from the accountants within the next eight to 12 weeks, he said.

Briefing journalists after an hour-long meeting with Planning Commission Deputy Chairman Montek Singh Ahluwalia, Mr. Parekh said: “Unless the accountants who are restating the accounts confirm the receivables, we do not know the veracity of correctness of the receivables.” Moreover, the receivables are on time, the financial assistance may not be needed, he said.

Noting that collections were coming in every day, he said: “Satyam is a running company. It is an ongoing concern. Lot of collections are planned.”

The government-appointed board of Satyam has engaged the services of international auditing firms KPMG and Deloitte to restate the company’s accounts following its founder chairman B. Ramalinga Raju’s confession of having fudged the company’s accounts. “We are trying our best to salvage the company,” Mr. Parekh said. On the issue of HDFC’s exposure in Satyam’s group companies such as Maytas Infra and Maytas Properties, he said the housing finance company had no exposure in them. Likewise, National Housing Bank chairman S. Sridhar also said the housing regulator was collecting information about exposure of housing finance companies in the Satyam group companies.

The government has moved well to avert a further crisis in Satyam Computer Services Ltd. In deciding to do away with the old board and getting three respected professionals—Deepak Parekh, Kiran Karnik and C. Achuthan—to oversee the troubled company, the government has averted a further crisis of confidence.

The next step, too, is welcome. Commerce and industry minister Kamal Nath has suggested that money will be provided to the company that still has good clients and a qualified workforce. It’s best that a consortium of banks gives a short-term line of credit to help Satyam tide over its current liquidity problems, rather than put taxpayer money on the table.

But the next steps have to be taken more carefully. There is a chance that Satyam could now be the victim of political overreach, as state and national politicians start meddling with longer-term strategic issues—including the question of ownership. These are questions that are best left to the new board—which should decide how to run Satyam or sell it.

सत्यम के घोटाले के बाद अब कर्मचारियों पर भी गाज गिरनी शुरू हो गई है। अभी तक खबरें आ रही थीं कि सत्यम स्टाफ से 10,000 लोगों की छटनी हो सकती है लेकिन अब खबर है कि स्टाफ को दो महीने तक कोई सेलरी भी नहीं मिलेगी।

सत्यम के कर्मचारियों के अनुसार उन्हें ई-मेल द्वारा यह सूचना दी गई है। साथ ही कंपनी ने बुरे समय में सहयोग की भी अपील की है। वहीं कंपनी प्रवक्ता इस तरह के मेल से इंकार कर रहे हैं। साथ ही उनका कहना है कि छटनी संबंधी खबरों के बारे में भी उन्हें कोई जानकारी नहीं है।

गौरतलब है कि आठ हजार करोड़ के घोटाले के बाद सत्यम की आर्थिक हालत काफी खराब हो चुकी है और कर्मचारियों की सैलरी पर उसे प्रति माह करोड़ों रुपए खर्च करने पड़ते हैं।

गौरतलब है कि देश की चौथी बड़ी सॉफ्टवेयर कंपनी सत्यम कंप्यूटर के चेयरमैन बी। रामालिंगा राजू ने बुधवार को इस्तीफा दे दिया। राजू ने अपने निवेशकों को एक चिट्ठी लिखी है, जिसमें कहा गया है कि कंपनी में फ्रॉड हुआ और कंपनी के मुनाफे को बढ़ा-चढ़ाकर पेश किया गया।

Warning of stern action under the law against the guilty, the government on Wednesday announced that the case of “financial bungling” by Satyam Computer Services would be referred to the Serious Fraud Investigation Office (SFIO) after verification of “facts” by the Registrar of Companies (RoC) in Hyderabad. The RoC has been asked to submit its report by January 14.

At a press briefing on the confessional letter by Satyam’s erstwhile Chairman, B. Ramalinga Raju, to the company’s board, the SEBI chairman and stock exchanges on the financial wrong-doing over the years, Minister for Corporate Affairs Prem Chand Gupta said: “We have received communication from Ramalinga Raju. Facts need to be verified. We have communicated the message to the Registrar of Companies in Hyderabad and given them a deadline of January 14, by when we will have all the information.”
